The Accusation: Endangering Horses

While the final verdict is still pending, a hearing officer has determined that there is sufficient cause to proceed with a provisional suspension of Rodriguez, who stands accused of putting horses at risk.

On December 12th, officer Armand Leone approved the immediate suspension of Rodriguez, a New York-based trainer. This provisional suspension means Rodriguez cannot participate in racing activities until the case is resolved. The Horseracing Integrity and Safety Authority (HISA) has the authority to issue such suspensions when it believes the allegations pose an imminent threat to the well-being of the horses.

Leone's ruling stated, "The Authority has demonstrated good cause to justify the suspension of the respondent pending a final adjudication." HISA promptly informed Rodriguez of his suspension, effective from 5 p.m. on December 16th.

During the hearing, HISA representatives argued that they have the right to impose an immediate suspension when there is good cause. In this instance, they claimed that Rodriguez had denied his horses necessary veterinary treatment.

HISA presented several cases where they alleged Rodriguez's horses did not receive lameness evaluations after being placed on the veterinarians' list. Leone, in his decision, noted that HISA's reason for suspension was the absence of veterinary treatment records for multiple horses regarding lameness evaluations or diagnostic treatments.

"The lack of treatment records indicates that covered horses were deprived of essential veterinary care," Leone stated.

Rodriguez, represented by Clark Brewster, a Thoroughbred owner and equine attorney, argued that the accusations were merely omissions in record-keeping and did not amount to a deprivation of care. They also pointed out that not all the referenced horses had been on the vets' list.

Rodriguez's defense team claimed, "Respondent's horses are regularly assessed by the attending veterinarian, Dr. Reyn Andrews, through personal observation and interviews with Rodriguez and his staff." They added that these examination records are not required to be uploaded to the HISA portal as they do not fall under "treatments, procedures, and surgeries."

Rodriguez's impressive record includes finishing in the top 100 in both earnings and wins for 15 consecutive years. He has primarily competed in claiming races but has also achieved grade 1 stakes wins with horses like Bella Sofia, Lady Ivanka, Dads Caps, Condo Commando, and Belle Gallantey.

During the hearing, Rodriguez spoke of his close attention to his horses, often riding them in the morning and keeping a watchful eye. He explained that he intentionally keeps his stable size small, with only 50-60 horses at a time, to ensure hands-on care. Rodriguez stated that when a horse is placed on the vets' list, he personally examines them to determine if an attending veterinarian should be called for further evaluation.

The hearing officer's decision highlighted that HISA's discovery of missing veterinarian treatment records for multiple horses regarding lameness evaluations or diagnostic treatments led to the investigation of four horses trained by Rodriguez: Jemography, Secret Rules, Spooky Lady, and Heavyweight Champs.

Jemography suffered a catastrophic injury to his left front leg during a workout at Belmont Park on December 13, 2024. Secret Rules was euthanized after breaking down during a breeze at Belmont on January 19, 2025. Records presented at the hearing indicate that Spooky Lady died in her stall on June 7, 2025, after being transported to Cornell Ruffian Equine Specialists for treatment following lameness in her left hind leg. Unfortunately, she died from a lacerated vessel as a complication of surgery. Heavyweight Champs was euthanized after a catastrophic breakdown while racing at Aqueduct on November 14, 2025.

HISA representatives based their argument for an immediate suspension solely on the standard of "deprivation of necessary care, sustenance, shelter, or veterinary care." The hearing officer found that the lack of prompt examinations by an attending veterinarian for Rodriguez's horses on the vets' list indicated violations of this rule.

Leone's decision stated, "A horse placed on the vets' list deserves prompt medical attention by an attending veterinarian to ensure proper diagnostics, treatment, and injury management. The veterinarian needs to examine the horse while the injury is still evident and the horse is symptomatic, typically within 48 hours of being placed on the list. Failing to do so constitutes a deprivation of necessary veterinary care and a failure to meet the standard of care expected of a trainer, thus endangering the welfare of the horses."
